HAROON FAROOQ VS FEDERATION OF PAKISTAN S. 124a---Constitution of Pakistan, arts. 19 & 19a---Sedition---Freedom of speech and right to information---Role of media---Freedom of press---Scope---Proper functioning of a modern participatory democracy requires media to be free, active, professional and enquiring---Only limitation that can be placed on a free press is one enumerated as exceptions to art. 19 of the Constitution and must be proportionate and no more than is necessary to promote legitimate object of restriction---Offence of sedition in S. 124a, P.P.C., travels beyond the limitation placed by art. 19 of the Constitution regarding role of press and its freedoms which must not be abridged on the misplaced notion that government of the day can suppress political speech at will.
