REHMATULLAH VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Reappraisal of evidence---Call Data Record (CDR), production of---Inconsequential---Call Data Record (CDR) of the SIMs of the deceased and appellants (accused persons) were produced in the prosecution evidence but no documentary evidence was produced before the Trial Court to establish that the SIMs mentioned in the call data record were in the name of the deceased or appellants---Moreover, no phone recording or its transcript was produced in evidence to show the nature of the conversation between the appellants and the deceased---Evidence of CDR produced in this case was inconsequential for the prosecution---Prosecution had failed to prove its case against the appellants beyond the shadow of doubt---Appeals were allowed, and the appellants were acquitted of the charges.
