Citation Name: 2024 YLR 1113 QUETTA-HIGH-COURT-BALOCHISTANBookmark this Case KHAN MUHAMMAD VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Benefit of doubt---Statement of injured eye-witness exoverating the accused---Accused was charged for committing murder of the deceased by firing---Injured female eye-witness, who was injured in the alleged occurrence, fully exonerated the accused from the commission of the alleged offence---Said witness stated that the accused was innocent and had not committed the offence---Said witness was an independent witness by all means because she was neither related to the accused nor inimical toward the complainant party, therefore, the prosecution declared her hostile and requested the trial Court to cross-examine her---An opportunity was provided to the prosecution to cross-examine her, and the said witness was cross-examined at length, wherein she denied that the accused committed the offence---Circumstances established that the prosecution had failed to establish the culpability of the accused through reliable, trustworthy, and confidence-inspiring evidence---Appeal against conviction was accordingly allowed.
