ALI HASSAN VS State Ss. 302(b), 324, 109, 148 & 149---anti-Terrorism act (XXVII of 1997), S. 7---Qatl-i-amd, attempt to commit qatl-i-amd, abetment, rioting armed with deadly weapon, unlawful assembly, act of terrorism---appreciation of evidence---Benefit of doubt---Related and interested witnesses---accused were charged that they made firing upon the complainant party, due to which two persons died whereas two persons sustained firearm injuries---assessment of evidence reflected that all the witnesses were related to each other either in blood relation or due to their organization therefore their evidence was assessed carefully---although, witnesses received the injuries during the incident but they had not deposed actual truth in respect of the incident and made dishonest improvements before the Trial Court---Circumstances established that the prosecution had failed to prove its case against the accused beyond shadow of any doubt---appeal against conviction was accordingly allowed.
