Citation Name: 2024 YLR 1662 PESHAWAR-HIGH-COURTBookmark this Case State VS AKBAR KHAN Ss. 302(b) & 34---Criminal Procedure Code (V of 1898), S. 417(2-A)---Qatl-i-amd, common intention---Appeal against acquittal---Appreciation of evidence---Motive not proved---Accused/respondents charged for committing murder of the brother of the complainant---Prosecution had not been able to prove the alleged motive for the commission of the subject offence, which was stated to be that the deceased was allegedly teasing a lady/witness on telephone and the said fact was allegedly disclosed by the said lady to the accused/respondent, which prompted the accused to kill the deceased in the company of the other accused in their Hujra---Prosecution could not bring on record any CDR data in respect of the alleged telephonic contacts/communication of the deceased with said lady or for that matter the CDR record of the cell phone, which was in the name of a witness but as per prosecution's version the same was used by the accused/respondent---Appeal against acquittal being bereft of any merits was dismissed, in circumstances.
