Iftikhar alias Hera alias Charlie VS State Ss. 302(b) & 302(c)---Qatl-i-amd---Appreciation of evidence---Sentence, reduction in---Crime weapon recovered on the pointation of accused---Reliance---Accused was charged for committing murder of the brother of complainant by stabbing---Accused was arrested one day after the incident and six days after his arrest he confessed to the crime to the police and then led the police on his pointation to where he had hidden the murder weapon (knife/churri/dagger) in his own house---Admittedly, the confession before the police was inadmissible in evidence however his pointation of the murder weapon hidden in his house in a place which only he could have known about was evidence against the accused---As per chemical report the knife/churri/dagger which was found on the pointation of the accused was also found to be stained with human blood---Circumstances established that prosecution had proved its case against the accused beyond any shadow of doubt, however, sudden quarrel broke out between the accused and the deceased which led the accused after being provoked by the quarrel suddenly to give one stab wound with knife to the chest of the deceased without premeditation, thus offence under S.302(b), P.P.C was converted into offence under S.302(c), P.P.C---Life imprisonment was converted into sentence for 14 years---Appeal was dismissed with modification in sentence, in circumstance.
