Rao Humayun Waqas VS State Ss. 302(b), 109 & 34---Qatl-i-amd, abetment, common intention---Appreciation of evidence---Recovery of weapon of offence and crime empties---Inconsequential---Accused was charged the he along with co-accused in furtherance of common intention committed murder of the son of complainant by firing---Record showed that pistol .9mm was recovered---Recovery of pistol .9mm was not helpful to the prosecution in the sense that it did not match with the spent shells collected from the spot---Thus, recovery was totally inconsequential losing its corroborative effect in the case---Circumstances established that prosecution had not been able to establish the charge against the accused beyond any shadow of doubt---Appeal against conviction was accordingly allowed.
