Citation Name: 2024 YLR 383 PESHAWAR-HIGH-COURTBookmark this Case ZALWANOOR VS State Ss. 302(b) & 324---Qatl-i-amd, attempt to commit qatl-i-amd---Appreciation of evidence---Substitution a rare phenomenon---Accused was charged for committing murder of the brother of complainant by firing---Close relationship between the parties could not be overlooked as the accused happened to be the uncle of the deceased; there was no blood feud between the parties and the dispute was over a house; so in the attending circumstances of the present case, it was not acceptable that the accused was substituted for the real culprit, as in such like circumstances substitution was a rare phenomenon---Circumstances established that the prosecution succeeded in proving the charge against the accused beyond any shadow of doubt---Appeal against conviction was dismissed accordingly.
