PARAS ALI GADANI VS State Ss. 302(b) & 34--- Qatl-i-amd, common intention--- Appreciation of evidence--- Related witnesses, evidence of---Reliance---Accused were charged for committing murder of the brother of the complainant---Though the witnesses were close relatives of the complainant and the deceased but they had no strong motive to falsely implicate an innocent person in a murder case while substituting the actual culprit---Mere fact that a witness was closely related to the accused or deceased or he was not related to either party, was not a sole criterion to judge his independence or to accept or reject his testimony rather the true test was whether the evidence of a witness was probable and consistent with the circumstances of the case or not---Circumstances established that the prosecution had proved its case beyond a reasonable doubt against the accused by producing reliable, trustworthy, and confidence inspiring oral evidence as well as medical evidence---Appeal against conviction was dismissed accordingly.
