Mst. SADIQAN BEGUM VS MUHAMMAD SIDDIQUE S.42---Oral gift---Mutation---Proof and scope---Mutation alone does not confer legal title to immovable property---No evidence existed of the alleged oral gift transaction---Having concluded that there was absolutely no evidence regarding transaction of impugned gift and that a mutation could not by itself be considered a document of title, it was evident that even the impugned mutation had not been proved in terms of S. 42 of the Punjab Land Revenue Act, 1967, which required that such mutation had to be presented and sanctioned in the common assembly (Jalsa-e-Aam) of the estate concerned---Civil revision was allowed and suit filed by petitioner/plaintiff (female heir) was decreed.
