INDUS MOTOR COMPANY LIMITED VS FEDERATION OF PAKISTAN through Secretary Ministry of Industries and Production S. 9---Jurisdiction of civil court---Opposite party instituting Constitutional petition seeking implementation of order challenged before civil court---Effect, legality and scope---Pendency of proceedings before another forum without a specific restraining order does not bar the civil court from exercising its jurisdiction vested under the law---Jurisdiction of civil courts under S. 9 of C.P.C. is plenary in nature and extends to all suits of civil nature except those expressly or impliedly barred---Unless there is a clear statutory exclusion, civil courts cannot relinquish their jurisdiction---When an administrative order affects civil rights and is alleged to be passed without jurisdiction the remedy of filing civil suit cannot be denied.
