PUNJAB GROUP OF COLLEGES VS PROVINCE OF THE PUNJAB through Chief Secretary, Lahore Ss. 3 & 6---Punjab Private Educational Institutions (Promotion and Regulation) Rules, 1984, R. 5---Registration of Private Educational Institutions---Issuance of notifications qua amendment in revised fee schedule for issuance of new/extension in registration certificates to private educational institutions in the Province of Punjab---Contention of the appellant was that revision of fee schedule and fixation of time for registration certificate was beyond the scope of applicable law and rules---Validity---Neither any specific duration for the validity of registration was stipulated in Ss. 3 and 6 of the Punjab Private Educational Institutions (Promotion and Regulation) Ordinance, 1984, nor the notifications cited any governing laws or rules that granted any power to the respondent to establish a fixed period for the validity of such registration---Through the notifications respondent had attempted to amend R. 6 of the Punjab Private Educational Institutions (Promotion and Regulation) Rules, 1984, (Rules)---Notifications were issued in a legal vacuum---No executive authority could take action without the backing of a valid law---Appeal was allowed, in circumstances.
