Citation Name: 2025 MLD 1365 KARACHI-HIGH-COURT-SINDHBookmark this Case Mansoor Ali Khoso VS Federation of Pakistan through Secretary Finance, Islamabad R.12 ---Constitution of Pakistan, Art. 199--- Suit withdrawn on the basis of compromise --- Refund of court-fee claimed ---Law providing alternate remedy for processing the refund of court-fee---Relevant forum --- Scope ---The documents confirmed that the petitioner had instituted the suit and that it was formally withdrawn on account of a compromise, following which a certificate for the return of the judicial e-Stamp was issued by the competent court and was available on the file --- Despite multiple representations before the relevant authorities and recourse to the Wafaqi Mohtasib the petitioner's grievance remained unredressed constraining him to file the present Constitutional petition---Held: The e-Stamp in question was issued to the petitioner under the Sindh e-Stamp Rules 2020, R. 12 of which governed the refund of e-Stamps --- In light of R.12 of the Sindh e-stamp Rules, 2020 the petitioner was required to approach the Chief Inspector of Stamps or Collector for redressal of his grievance regarding refund of court-fee who was directed to decide the issue strictly in accordance with law --- Petition was disposed of, in circumstances.
