Zaka-ud-Din Dewan VS Federation of Pakistan through Secretary Interior R. 22---Constitution of Pakistan, Art. 199---Constitutional petition---Passport Control List (PCL)---Federal Government, jurisdiction of---Petitioner was aggrieved of placing his name on PCL, which resulted in imposing ban on his travelabroad---Validity---Name of petitioner was placed on PCL based on the recommendation of Home Department of Punjab, due to involvement in criminal case registered under P.P.C. and Anti-Terrorism Act,1997---Petitioner's pre-arrest bail petition was dismissed as withdrawn on the grounds that hehad been found not guilty during investigation, as indicated by statement of investigating officer, which was incorporated in order of Trial Court---Nothing was placed on record that could indicate that Federal Government granted approval for placing petitioner's name on PCL, as provided by R.22(1) of Passports Rules, 2021---Inclusion of petitioner's name on PCL violated his fundamental rights to due process, liberty, life and freedom of movement, all of which were guaranteed by the Constitution---High Court directed the authorities to remove name of petitioner from PCL as there was no valid justification for placing his name on the PCL---Constitutional petition was allowed, in circumstances.
