Khawaja Muhammad tayyab VS State S. 302(b)---appreciation of evidence---Night time occurrence---Identity of the accused doubtful---accused was charged for committing murder of the husband of complainant---Rough and scaled site plans of the place of occurrence showed the presence of the deceased at point (1) which was almost adjacent to the houses of "KR" and "MH", who had not been produced in support of the story of prosecution---Complainant stated in her cross-examination that accused was at a distance of 10/12 feet from her (them) at the time of occurrence which took place at midnight---In these circumstances, identity of the appellant was also not free from doubt---appeal against conviction was allowed, in circumstances.
