Shakeel VS State S.302(b)---Qatl-i-amd---Appreciation of evidence---Unexplained delay in conducting postmortem examination of the deceased---Consequential---Accused was alleged to have murdered the son of complainant by firing him---Trial Court convicted the accused under S.302(b), P.P.C and sentenced him to imprisonment for life---Held: Postmortem examination of the deceased was conducted after unjustifiable lapse of time---Prosecution had failed to provide any explanation for this delay---Time of occurrence was given as 11:00 p.m. on 24.03.2016 and time of report as 06:50 am in the FIR, whereas, according to statement of doctor he conducted autopsy on the dead body of the deceased at 06:45 p.m. on 25.03.2016. viz after a delay of 19 hours and 45 minutes if counted from the time of occurrence---In such eventuality the most natural inference would be that the delay so caused was for preliminary investigation and prior consultation to nominate the accused and plant eye-witnesses of the occurrence---Prosecution had failed to prove its case against the accused beyond reasonable doubt---Consequently, appeal was allowed and the conviction and sentences of the accused were set aside and he was acquitted of the charge by extending him the benefit of doubt.
