Irfan Ali VS State Ss. 302(b), 324, 337-F(iii), 109, 148 & 149---Qatl-i-amd, attempt to commit qatl-i-amd, ghayr jaifah mutalahimah, abetment, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Presence of eye-witnesses at the spot not doubted---Accused were charged for committing murder of the deceased by firing and causing firearm injuries to the witness---According to the prosecution case, besides an injured eye-witness, the incident was also witnessed by complainant and two other witnesses---As far as the latter mentioned three eye-witnesses were concerned, no material whatsoever was brought on record by the defence to establish that they were not present at the crime scene or should have been in attendance at some other place in accordance with daily pursuit of their lives---As regards an injured witness, he appeared before the Trial Court with the claim of having received firearm entry wound at left side of his lower abdomen---There were multiple factors providing strength to the acclaimed presence of eye-witness at the spot and receipt of injuries during incident was one of them---Presence of a injured witness during the occurrence is always considered well beyond doubt, because he has stamp of injuries on his person---Circumstances established that the prosecution had succeeded in proving the charge against the accused, however due to some mitigating circumstances, death sentence was converted into imprisonment for life---With said modification in sentence, appeal was dismissed.
