Irfan Ali VS State Ss. 302(b), 324, 337-F(iii), 109, 148 & 149---Qatl-i-amd, attempt to commit qatl-i-amd, ghayr jaifah mutalahimah, abetment, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Delay of two hours and thirty five minutes in lodging the FIR---Inconsequential---Accused were charged for committing murder of the deceased by firing and causing firearm injuries to the witness---Record revealed that the incident which formed the basis of the instant case took place on 03.05.2018 at about 5:00 p.m. that was in broad daylight, during which one person lost his life after the receipt of fire shots made by appellant---As per the record, witness also endured two firearm injuries---Incident occurred in a Chak, which was situated 23 kilometers away from Police Station---Deceased and injured were shifted to the hospital, and complainant reported the matter before police at 6:45 p.m. in DHQ Hospital---Complaint was transmitted to the Police Station at 7:00 p.m. by Police Constable, upon which the FIR was registered by Moharrar at 7:35 p.m.---All the said witnesses appeared before the Trial Court and deposed in line with the prosecution case---In those circumstances, it could conclusively be held that the timing asserted by the prosecution qua the registration of FIR had not been challenged---Circumstances established that the prosecution had succeeded in proving the charge against the accused, however due to some mitigating circumstances, death sentence was converted into imprisonment for life---With said modification in sentence, appeal was dismissed.
