Qaiser Abbas VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Recovery of weapon of offence on the pointation of accused---Inconsequential---Accused was charged for committing murder of the complainant by firing---No doubt 30-bore pistol along with two live bullets was allegedly recovered on the pointing of appellant-accused and there was no report of the Forensic Science Laboratory, that the weapon had matched with the crime empties---As such no crime empty was recovered from the place of occurrence which could be matched with the weapon recovered---Contrary to it, the report of Forensic Science Laboratory reflected that the allegedly recovered weapon was in working condition, therefore, there was no incriminating recovery in the case available on record to connect the appellant with the commission of offence---Appeal against conviction was allowed, in circumstances.
