Gulraiz Shahzad VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Sentence, reduction in---Mitigating circumstances---Accused was charged for committing murder of the husband of complainant by inflicting churri blow---According to the Investigating Officer, he did not send the knife to the Forensic Science Agency as it was not blood-stained---Appellant had been convicted and sentenced to death for the murder of the deceased---In such an eventuality, the same could be considered a mitigating circumstance---Furthermore, though it was mentioned in the crime report/FIR that appellant started quarreling with husband of complainant and when refrained, he became furious/angry and committed the occurrence yet it had not come on the record that what was the dispute about, therefore, immediate cause of occurrence remained shrouded in mystery---Thus, the appellant's death sentence was converted into imprisonment for life---Appeal was dismissed with modification in sentence.
