Citation Name: 2025 PCrLJ 633 KARACHI-HIGH-COURT-SINDHBookmark this Case Rehman Bacha VS State S. 302(b)---Criminal Procedure Code (V of 1898), S. 342---Qatl-i-amd---Appreciation of evidence---Statement of accused under S.342, Cr.P.C---Scope---Accused was charged for committing murder of the brother-in-law of complainant by firing---Accused claimed in his S.342 Cr.P.C statement that he was at his village at the time of the incident and he produced one defence witness in support of his claim---Fact remained that accused surrendered before the police from his village in other Province which bolstered his claim especially as it was found that there was no reliable identification of the accused as the person who shot and murdered the deceased at the crime scene---Thus, the prosecution hadnot proved its case against the accused beyond a reasonable doubt---Appeal against conviction was allowed, in circumstances.
