Citation Name: 2025 PCrLJ 881 KARACHI-HIGH-COURT-SINDHBookmark this Case ARSHAD HUSSAIN VS State Ss. 302(b), 392, 396, 397 & 34---Qatl-i-amd, robbery, committing robbery or dacoity, at the time of committing dacoity or robbery the offender uses any deadly weapon or causes grievous hurt to any person or attempts to cause death or grievous hurt to any person, common intention---Appreciation of evidence---Sentence, quantum of---Mitigating circumstances---Single fire shot---Intention to commit dacoity and not murder---Accused was charged for committing murder of the brother of complainant by firing while snatching money---Record showed that intention of the appellant was to snatch money from the deceased in his shop and not to commit his murder; when more money was demanded by accused persons, a scuffle started and appellant fired a single shot upon the deceased on his abdomen, and fire was not repeated---Single mitigating circumstance, available in a particular case, would be sufficient to put on guard the judge not to award the penalty of death but life imprisonment---Thus, sentence of death awarded to the appellant was reduced to imprisonment for life---Appeal against conviction was dismissed with said modification in sentence.
