Ali Akbar Zia VS State Ss. 302(b), 109 & 34---Qatl-i-amd, abetment, common intention---Appreciation of evidence---Motive not proved---Accused were charged for committing murder of the father of complainant by firing---Motive set up by the prosecution in the oral statement and FIR and deposed by the complainant, remained un-proved---Prosecution's case in that regard was vague and could hardly inspire confidence---Regarding the motive for the crime, the prosecution did not produce any documentary evidence---Investigating Officer also did not make any effort to collect any evidence that may have proved the motive of the crime attributed to the appellant---Therefore, the prosecution did not prove beyond reasonable doubt the motive for the crime committed by the appellant set up before the Trial Court---Circumstances established that the prosecution had failed to prove its case against the appellant beyond any shadow of doubt---Appeal against conviction was allowed accordingly.
