Prof. Dr. SHEIKH ASRAR AHMAD VS GOVERNMENT OF PUNJAB through Secretary Higher Education arts. 199(1)(a) & 199(1)(c)---Constitutional jurisdiction of High Court---Scope---Jurisdiction of High Court under Clause (c) of art.199(1) of the Constitution---Wider than that available under Clause (a) of art.199(1) of the Constitution---"Enforcement of fundamental rights"---Scope---Judicial power under clause (c) of art.199(1) of the Constitution is wider than other provision in the said article inasmuch as under such exercise of jurisdiction High Court can issue any appropriate direction for enforcement of any of the Fundamental Rights guaranteed under Chapter 1 of Part II of the Constitution, however, issuance of such direction should be necessary for the enforcement of the Fundamental Right, appropriate in the facts and circumstances of the case, which must not be a disproportionate measure---Contrarily, directions in the nature of mandamus or prohibition under clause (a) of art.199(1) of the Constitution are confined to act as required by law or refrain from acting in a manner not permitted by law.
