ALI RAZA JAMALI VS GOVERNMENT OF BALOCHISTAN through Chief Secretary Civil Secretariat, Quetta R. 12-a---Date of birth of civil servant, changing of---Timeline---Record revealed that respondent filed an application for the post of Deputy Director (BPS-18) in Balochistan Public Service Commission, in the year 2005---after appointment, the department maintained his Service Book and at the time of induction in the government job, his date of birth was mentioned as 07.05.1963---Respondent / department time and again issued seniority list wherein too, the date of birth of respondent was mentioned as 07.01.1963---Record further showed that the respondent/department in violation of applicable law and Rules, particularly, R.12-a of the Balochistan Civil Servant (appointment, Promotion and Transfer) Rules, 2009, altered the age of respondent vide Notification dated 22.01.2019, upon which certain objections were filed and in result whereof, the respondent / department issued a corrigendum dated 10.03.2021, whereby, the age of respondent was corrected to its original position as 07.05.1963---Respondent filed a civil suit before the Civil Court and got a ex-parte decree passed in his favour, and on the strength of which (ex-parte decree) he got modified his Secondary School Certificate (SSC) and a revised Secondary School Certificate on 25.06.2008---Pertinently, the respondent obtained revised certificate after a delay of approximately 26 years of his participation in the SSC examination---alteration in the date of birth has been adjusted within or after two years of initial appointment or at any point of time, as per provision of the Balochistan Civil Servants (appointment, Promotion and Transfer) Rules, 1973---High Court set aside the impugned Notification as well as order and decree passed by Civil Court being illegal---Constitutional petition, was allowed, in circumstances.
