ADIL KHAN BAZAI VS ELECTION COMMISSION OF PAKISTAN art. 63a(1)---Declaration of defection---Principle---Power to make a declaration of defection, under article 63a(1) of the Constitution has been granted only to Party Head of a political party, not to any other office bearer of the party and that can be exercised only in relation to a member of Parliamentary Party of a political party in the House, not to any other member of the House---Existence of such two facts is a condition precedent for the exercise of power to make declaration of defection against a member of House and for the exercise of jurisdiction by Election Commission to confirm such a declaration.
