ADIL KHAN BAZAI VS ELECTION COMMISSION OF PAKISTAN arts. 63a(3) & 63a(4)---Declaration of defection--- Election Commission---Exercise of jurisdiction---Principle---Election Commission has no power to conclusively determine jurisdictional facts but only has power to objectively ascertain existence of jurisdictional facts before exercising jurisdiction conferred upon it under articles 63a(3) and (4) of the Constitution, for the purpose of determining alleged defection of a member from his political party---Findings of Election Commission on a jurisdictional fact, such as whether member concerned belongs to parliamentary partly of a political party, is not conclusive---Rather, it is subject to correction by Supreme Court as its appellate forum, and ultimately to final determination by a Civil Court of plenary jurisdiction.
