UMAR AKBAR ALI GHUMMAN VS Mst. MARIA JAVED CHEEMA Ss. 5, Sched. & 14---Constitution of Pakistan, Art.199---Constitutional jurisdiction of the High Court---Appeal against an interim order---Scope---Quantum of interim maintenance not a ground for invoking Constitutional jurisdiction of High Court---Section 14 of the Family Courts Act, 1964, being a special law, has placed an embargo on the right of appeal against an interim order pertaining to maintenance---It is a settled principle of law that the quantum of the interim maintenance cannot be made a ground for invoking the Constitutional jurisdiction of the High Court---Therefore, when a statute specifically excludes a remedy, a petition in terms of Art. 199 of the Constitution cannot be held to be maintainable against the said order, as it would tantamount to circumventing the intent of the legislature and frustrating the express provision of law.
