FIDA HUSSAIN VS State S. 302(b)---Criminal Procedure Code (V of 1898), S. 367(5)---Qatl-i-amd---Quantum of sentence---Determining factor---Expression "having regard to the facts and circumstances of the case" is of significance in the context of exercising discretion by Court in handing down one of the two prescribed punishments---If accused is convicted of an offence punishable with death and Court sentences him to any punishment other than death, then under S. 367(5), Cr.P.C. the reason why sentence of death was not passed has to be recorded in the judgment.
