Anees Ur Rehman VS State Ss. 302(b) & 34---Qatl-i-amd, common intention---Appreciation of evidence---Recovery of 'dupatta' and 'hammer' at the instance of accused---Inconsequential---Accused was charged that he along with his co-accused committed murder of his wife/daughter of the complainant---Record showed that a dupatta and hammer were recovered at the instance of appellant---However, such recoveries were inconsequential for the reasons that the same were ordinary things, easily available in the market---Moreover, the prosecution had failed to associate any independent witness of the locality during recovery proceedings and, thus, the mandatory provisions of S. 103, Cr.P.C., had flagrantly been violated in that regard---Circumstances established that the prosecution could not prove its case against the appellant beyond any shadow of doubt---Appeal against conviction was allowed in circumstances.
