Muhammad Ramzan VS State S. 302(b)---Qanun-e-Shahadat (10 of 1984), Art. 122---Qatl-i-amd---Appreciation of evidence---Shifting of burden of proof---Accused was charged for committing murder of his wife/sister of complainant by cutting her neck with churri---By virtue of Art.122 of the Qanun-e-Shahadat Order, 1984, some part of the onus was shifted to the appellant to explain the circumstances in which his wife had died an unnatural death in his house which part of the onus had not been discharged by the appellant---When every other piece of evidence relied upon by the prosecution had been found to be utterly unreliable then the appellant could not be convicted for the alleged murder simply on the basis of a supposition---Circumstances established that the prosecution had failed to prove its case against the appellant beyond any shadow of doubt---Appeal against conviction was allowed accordingly.
