Muhammad Mohsan VS State Ss. 302(b), 148 & 149---Qatl-i-amd, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Delay of 12 to 18 hours in conducting autopsy---Consequential---Accused was charged for committing murder of the son of complainant by firing---Undisputedly, there was a noticeable delay in conducting autopsy of the dead-body of deceased because Medical Officer stated in his examination-in-chief that the time elapsed between death and postmortem examination was 12 to 18 hours---Such noticeable delay was normally occasioned due to incomplete police papers necessary to be handed over to the Medical Officer to conduct the postmortem examination of dead body of the deceased which happened only when the complainant and police remained busy in consultation and preliminary inquiry regarding the culprits in such cases of un-witnessed occurrence---Appeal against conviction was allowed, in circumstances.
