Sarwat Bibi VS Muhammad Idrees Kiani Ss. 302(b), 324, 337, 147, 148 & 149---arms act (XX of 1965), S. 13---Qatl-i-amd, attempt to commit qatl-i-amd, causing hurt, rioting, rioting armed with deadly weapon, unlawful assembly, possession of illicit weapon---appreciation of evidence---appeal against acquittal---Benefit of doubt---accused was charged for causing hurt to the complainant by firing, who died later on---at the time the deceased was being moved into the vehicle, both the DSP and his driver were present on the spot, yet neither of them made any statement regarding the third gunshot fired by the accused-respondent---Given these observations, it was reasonable to conclude that either party failed to present a wholly accurate account and the case appeared to be shrouded in mystery, casting serious reservations on the prosecution's narrative---Circumstances established that the prosecution had not been able to prove its case beyond any shadow of doubt---appeal against acquittal was dismissed accordingly.
