Aijaz Ali VS State Ss. 302(b) & 311---Qatl-i-amd, ta'zir after waiver or compounding of the right of qisas in qatl-i-amd---Appreciation of evidence---Recovery of weapon of offence from the possession of accused---Reliance---Accused was charged for committing murder of his mother by inflicting hatchet blows due to suspicion that she went away for purpose of meeting with someone---Crime weapon viz. blood stained hatchet was recovered from the possession of the appellant---Investigating Officer received the report in positive which was sent to the Chemical Examiner for analysis of dry blood kameez, shalwar with elastic, dupatta, jacket and soil---Recovered hatchet also supported the version of the complainant---No reason was found for the complainant to have falsely implicated the appellant in a case carrying capital punishment---Version given by the complainant inspired confidence in all respects and the same could safely be acted upon in the given situation---Thus, no fault was found in the evidence given by the complainant which got further corroboration through the reliable evidence led by the prosecution on that point---Circumstances established that the prosecution had proved its case against the accused but due to some mitigating circumstances, death sentence was converted into imprisonment for life---With said modification in sentence, appeal against conviction was dismissed, accordingly.
