Wajid Ali VS State Ss. 302(b), 201, 109, 120-B, 148 & 149---Qatl-i-amd, causing disappearance of evidence of offence, abetment, criminal conspiracy, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Sentence, reduction in---Mitigating circumstances---Convict swayed by emotions---Accused were charged for committing murder of the brother of complainant and buried the dead body with the help of co-accused---Evidently, appellant "W" was equally related to the house as the deceased was and he was attached to the family more than the deceased---Deceased lost his life because of the suspected illicit relationship with the sister-in-law of the appellant, and the same turned to be the cause of appellant's annoyance and the feelings went so deep which prompted the appellant "W" to kill the deceased---In statement of accused "W", the cause was mentioned as the illicit relationship between his sister-in-law and deceased and appellant "W" while confessing his guilt confirmed the same to be the cause of killing---In such circumstances, appellant "W" was swayed by his emotion and attachment to the family---When this was the state of affairs, the Court lurked no doubt in holding that the approach of the Trial Court to the quantum of sentence was not in accordance with law which called for interference---Appeal was partly allowed, conviction of the appellant "W" was maintained, however, his sentence of death was converted into imprisonment for life---Appeal against conviction was dismissed with modification in sentence, in circumstances.
