Akhtar Nawaz VS Azra Begum O. VII, R. 11---Rejection of plaint---Scope---Plaintiffs challenged the legality / authenticity of a number of mutations, however, their plaint was rejected under O.VII, R.11 C.P.C.---Defendants filed revision as the Appellate Court set-aside the plaint-rejecting order passed by the Trial Court---Validity---Admittedly, both the parties were siblings inter se and dispute pertained to legacy of their father---Whether the disputed gift mutation(s) were validly made or the same was the result of any fraud, were the questions, which would be determined by the Trial Court after recording of pro and contra evidence---Thus, rejecting such a plaint at the initial stage would not meet the ends of justice---High Court maintained the impugned order and judgment passed by the Appellate/ District Court being in accordance with law---Revision filed by the defendants, being merit-less, was dismissed in limine, in circumstances.
