Muhammad Afzal VS State S. 302(b)---Qatl-i-amd---Appreciation of evidence---Motive not proved---Accused was charged for committing murder of the sister of complainant by cutting her throat with a sharp edged sickle---It was noteworthy that although it had been alleged by the prosecution witnesses that appellant used to quarrel with deceased but admittedly the deceased was living with the appellant in his house for last 20-years---Deceased lived with the appellant till the day of occurrence---Prosecution had not produced copy of any suit whereby the deceased sought decree for dissolution of marriage on the basis of Khula or she had ever filed any application before the concerned SHO against the appellant for quarreling with her---No specific reason of quarrel between the appellant and the deceased had been mentioned by any prosecution witness---Thus, the motive alleged by the prosecution had not been proved in this case---Circumstances established that the prosecution had failed to prove its case against the appellant beyond the shadow of doubt---Appeal against conviction was allowed accordingly.
