Sardar Khan VS Member-II, Board of Revenue, Balochistan S. 39---Balochistan Land Revenue Act (XVII of 1967), S. 163---Review of revenue orders---Jurisdiction of Board of Revenue---Scope---Petitioner assailed the order passed by the Board of Revenue whereby a review petition filed against an earlier order was entertained and allowed after a considerable lapse of time---Validity---Power of review is not an inherent power and must be expressly conferred by the statute governing the forum---Under S. 163 of the Balochistan Land Revenue Act, 1967, the Board of Revenue or any revenue officer is empowered to review any order passed by them, but such power is subject to strict limitations, including the grounds similar to those under Order XLVII, Rule 1, C.P.C. (discovery of new and important matter or mistake/error apparent on the face of the record) and must be exercised within a reasonable time---Review cannot be utilized as a garb for rehearing the entire matter or substituting a view simply because a different interpretation is possible, nor can it be used to condone gross laches on the part of a litigant---Board of Revenue exceeded its legal jurisdiction by reopening a settled controversy under the guise of review without pointing out any patent error or discovery of new evidence---Impugned order was declared illegal and set aside.
