VS Ss. 10(1), 10(2) & 30---Deceptive marketing practice---Proof---Comparison by Competition Commission---Complainant, a foreign company engaged in selling hair oil was aggrieved of selling of same product by respondent on the allegation of copy of trade mark, trade-dress, get-up, color scheme, packaging and labelling---Validity---Both the products did not disclose any confusing similarity in packaging of the two products---Trade-name / logo of complaint and respondent were visually and phonetically different---Color scheme of complainant was dark green whereas that of respondent was dark black---Both products used different fonts and writing style on the cartons and bottles---A different model angled towards customer was used on disputed product whereas in the relevant product, the model was positioned away from the customer and was looking into a mirror---Pictures of a fruit on the two cartons were distinctly different---Complainant failed to prove that respondent had engaged in deceptive marketing by fraudulently using trademark, product labelling and packaging of its product---Complaint lacked merit as there existed material differences, noticeable to the naked eye, in leading characteristics of the two products---Competition Commission absolved respondent of any wrongdoing under S. 10 of Competition Act, 2010 and the set aside inquiry report---Complaint was dismissed in circumstances.
