Allah Bakhsh VS Province of Balochistan S. 21---Specific Relief Act (I of 1877), S. 42---Suit for declaration and permanent injunction---Government land, allotment of---Cancellation of allotment---Scope---Petitioner assailed the order passed by the Revenue authorities whereby the commercial plot allotted to him was cancelled on the ground of violation of terms and conditions of the allotment order and non-construction within the stipulated period---Validity---Allotment of state land is a privilege regulated by the specific policies, rules, and conditions framed by the government from time to time, and an allottee is bound to strictly adhere to the covenants contained in the allotment letter---Record revealed that the petitioner was granted the plot subject to the specific condition that he would raise construction within a period of two years from the date of taking possession, failing which the allotment would stand automatically cancelled and the land would revert to the state without any further notice---Petitioner failed to commence or complete the construction within the allowed timeframe, and multiple extensions sought by him were also exhausted without any visible progress at the site---Show-cause notice was duly issued to the petitioner, affording him an opportunity of hearing, but his reply was found unsatisfactory---Competent authority, therefore, rightly exercised its powers under the terms of the grant and cancelled the allotment---Courts cannot extend the time limit prescribed under the statutory rules or contractual obligations unless authorized by law---Order passed by the department was based on factual correctness and legal parameters---Constitutional petition / suit filed by the petitioner was dismissed.
