HAIR BIYAR KHAN VS STATE S.497---Control of Narcotic Substances Act (XXV of 1997) [as amended by Control of Narcotic Substances (Amendment) Act (XX of 2022)], S.9(1), Sr. No.3(c)---Possession of chars---Bail, grant/dismissal of---Allegation against accused-applicant was recovery of 2000 grams chars from beneath driver seat of jeep being driven by applicant---Driver being incharge of vehicle was responsible for articles recovered from vehicle---On tentative assessment accused was found seated on driving seat and recovery was effected from beneath his seat---Offence fell within prohibitory clause of S.497(1), Cr.P.C.---Bail declined to accused-applicant---However, co-accused sitting on front seat and having no recovery from his exclusive possession fell within ambit of further inquiry---Bail allowed to co-accused.
