Pakistan Muslim League (N) through President, Khyber Pakhtunkhwa VS The Election Commission of Pakistan art.106, 'proviso'---Elections act (XXXIII of 2017), S.98---Election Rules, 2017, R.92(6)---Reserved seats---Independent candidate joining a political party---Effect---Election and allocation of reserved seats---Framework and scheme---Reserved seats are allocated to political parties in proportion to the general seats won, following the declaration of final results by ECP under S.98 of the Elections act, 2017 --- Furthermore, in view of the proviso to art.106 of the Constitution and sub-rule (6) of R.92 of Election Rules, 2017 any independent candidate who has won a general seat and whose name has been notified as such under S.98, but joins a political party within three days of such notification, shall be counted towards the credit of that political party for the purpose of allocation of reserved seats.
