Saeed akhtar VS State Ss. 302(b) & 109---Qatl-i-amd, abetment---Appreciation of evidence---Benefit of doubt---Unnatural conduct of eye-witnesses---Accused was charged for committing murder of the husband of complainant by firing---Record showed that deceased died at the spot but it was not understandable that if the eye-witnesses were present at the spot at the relevant time then why they did not immediately shift deceased to hospital which according to Investigating Officer was situated at a distance of 45/47 minutes of travelling from the place of occurrence---Circumstances established that the prosecution had failed to prove its case against the appellant beyond the shadow of doubt---Appeal against conviction was allowed, accordingly.
