Muhammad Irfan alias Pomi VS State Ss. 302(b), 148 & 149---Qatl-i-amd, rioting armed with deadly weapons, unlawful assembly---Appreciation of evidence---Recovery of pistol from the possession of accused---Reliance---Accused was charged that he along with his co-accused persons committed murder of the brother of complainant by firing---Record showed that a pistol 30 bore was recovered from the possession of appellant and positive report of the Forensic Science Agency was there---However, the same were not helpful to the prosecution because while effecting the said recovery from the appellant, the Investigation Officer had flagrantly violated the mandatory provisions of S.103, Cr.P.C., as no independent person was associated during the said recovery proceedings---Circumstances established that the prosecution otherwise proved its case beyond any shadow of doubt, however, due to some mitigating circumstances, death sentence was altered to imprisonment for life---With said modification in sentence, appeal against conviction was dismissed, in circumstances.
