MIR ZAMAN ALIAS MUHAMMAD ALAM VS STATE. Ss. 302(b), 324 & 34---Pakistan Penal Code (XLV of 1860)---Qatl-i-amd, attempt to commit qatl-i-amd, common intention---Appreciation of evidence---Related and interested witnesses, evidence of---Reliance---Scope. The accused was charged for committing murder of the brother of the complainant by firing and also causing firearm injuries to the complainant and a passerby. Undeniably, both the eye-witnesses of the occurrence were related to the deceased, but merely for that reason they could not be termed as interested witnesses. The term "related" was not equivalent to "interested". A witness could only be termed as an interested witness when he or she derived some benefit from seeing the accused person punished. A witness who was natural and was the only possible eye-witness in the circumstances of the case could not be termed as an interested witness. In the present case, one of the injured eye-witnesses was the complainant and brother of the deceased. He not only proved his presence at the place of occurrence but his testimony was also found consistent and confidence inspiring. The said witness had cogently described the manner of commission of the crime in detail. The testimony of an eye-witness who had himself received injuries carried more evidentiary value. The circumstances established that the prosecution had successfully proved the charge against the appellant beyond any reasonable doubt. Appeal against conviction was dismissed accordingly.
