SANAULLAH VS STATE. Ss. 302(b), 364-A, 377 & 34---Pakistan Penal Code (XLV of 1860)---Qatl-i-amd, kidnapping or abducting a minor for murder, unnatural offence, common intention---Appreciation of evidence---Delay of 22 days in lodging the FIR---Plausible and justifiable explanation---Scope. The accused was charged for abducting the son of the complainant, committing unnatural offence and murdering him. The prosecution case was that the minor deceased went missing on 25.07.2021 and the First Information Report was registered on 16.08.2021 after recovery of the dead body. The complainant stated that he had reported the matter on the same day i.e. 25.07.2021; however, the FIR was not registered because the photograph of the minor was not available. During cross-examination, the complainant provided a reasonable explanation for the delay in registration of the FIR and stated that he had initially approached the police station, however, the FIR was only recorded after the dead body was recovered. Thus, it could be inferred that the complainant being an illiterate person and unfamiliar with legal procedures was unaware of the consequences of not getting the FIR registered immediately. Considering the other circumstantial and incriminating evidence available on record, the delay in lodging the FIR appeared plausible and justifiable. Appeal against conviction was dismissed, in circumstances, however, the revision petition filed by the complainant for enhancement of sentence was allowed by enhancing the sentence from life imprisonment to capital punishment of death.
