Sunny Hakim VS State S. 497--- Penal Code (XLV of 1860), Ss. 394 & 411--- Robbery and recovery of stolen property--- Bail, grant of--- Delay in conclusion of trial---Trial Court framed charge on 29-04-2025 and prosecution was responsible for causing delay in conclusion of trial--- Accused had been behind the bars since 18-07-2023 and had already completed his statutory period of one year--- Accused made out acase for bail not only on merits but on statutory ground of delay in conclusion of trial as well--- There was no likelihood of conclusion of trial of accused in near future--- Relief on the basis of such right so accrued in favour of accused could not be refused to him unless he was found to be hardened, desperate or dangerous criminal, aprevious convict for an offence punishable with death or imprisonment for life or accused of an act of terrorism punishable with death or imprisonment for life, but no such exception was found against accused--- Bail was allowed, in circumstances.
