Sheraz VS State Ss. 22-a, 23, 28 & 32---Substandard or misbranded food, unhygienic or unsanitary conditions and business without licence--- appreciation of evidence--- Synthetic milk, preparation of---Benefit of doubt--- accused persons were convicted and sentenced variously with maximum imprisonment upto five years --- Validity--- Presence of materials used for manufacturing synthetic milk was found--- Prosecution was obliged to prove that accused had the intent to produce synthetic milk and they were actively engaged in its production--- Such material was not forwarded to any laboratory for chemical analysis nor to verify if it contained adulterated or substandard substances--- Prosecution failed to provide any proof or documentation indicating that material in question was sent to a laboratory for analysis or testing--- High Court set aside conviction and sentence awarded to accused persons after extending them benefit of doubt and they were acquitted of the charge--- appeal was allowed in circumstances.
