Qurban Ali VS State S. 497(2)--- Penal Code (XLV of 1860), 379, 419, 468 & 471--- Legal Practitioners and Bar Councils Act (XXXV of 1973), S. 58--- Punjab Legal Practitioners and Bar Councils Rules, 2023, R. 4.17--- Fake advocate, theft, forgery and using forged documents--- Bail, grant of--- Non-compliance of mandatory provision of law--- Accused was alleged to be a fake advocate and FIR was registered on the complaint of private persons---Held: Private person individually at his own could not initiate criminal proceedings until the process under Legal Practitioners and Bar Councils Act, 1973 was exhausted--- Neither in Legal Practitioners and Bar Councils Act 1973, nor in Punjab Legal Practitioners and Bar Councils Rules, 2023 there was any express provision that cognizance of offence under S.58 of Legal Practitioners and Bar Councils Act, 1973 could only be taken by the Court on the complaint of concerned Bar Council--- Before registration of FIR, the Punjab Bar Council was not taken on board, nor any application or complaint was filed before it and police had also not collected any documentary evidence in support of allegations as submitted by petitioner--- Case against petitioner was one of further inquiry--- Bail was allowed, in circumstances.
