Sardar ASIF RANDHAWA VS PRESIDENT BANK OF PUNJAB art.199---Disciplinary proceedings---Bank employee---Constitutional petition, filing of---Compulsory retirement from service, challenge to---Non-statutory rules of service---Maintainability of constitutional petition---Scope---Compulsory retirement being part of terms and conditions of service---The petitioner was serving as Deputy Director Operations in the respondent-Bank and was proceeded against through departmental inquiry and was ultimately awarded the major penalty of compulsory retirement---The departmental appeal against the said penalty was dismissed by the Bank---He thereafter invoked constitutional jurisdiction to challenge both orders---Primary issue in the present matter was "whether the constitutional petition was maintainable to challenge the order of compulsory retirement passed by the respondent-Bank where the petitioner's service conditions were governed by non-statutory rules?"---Held: The Rules and Regulations governing the service of employees of the respondent-Bank were non-statutory in nature, hence, for enforcement of the same, writ petition was not maintainable---Order of compulsory retirement from service, which was part of terms and conditions of service, which were governed by non-statutory rules, which were for the internal functioning of the Bank and framed by the Bank, thus, for assailing the same, the present petition was not maintainable---Constitutional petition dismissed, in circumstances.
